ICHIBAN KARATE NKY - UPDATED LIABILITY WAIVER & RELEASE / BILLING POLICIES

Each Member or Responsible Party must read and provide their electronic signature in order to enroll or continue with trial memberships or existing memberships/class passes to participate in any activities at Ichiban Karate NKY.  Students without an updated Waiver & Release / Policies & Procedures form on file will be asked to have one signed before participating in future classes beginning January 7, 2024.

A:  Liability Waiver & Release 

• I do hereby agree to participate or allow my minor child(ren) in Ichiban Karate NKY martial arts programs. I recognize the risks of injury that are common to any martial arts program that my child(ren) or I participate in and I do hereby waive and release NKY Martial Arts Programs LLC (DBA Ichiban Karate NKY) from and against any and all claims, actions, causes of action, damages, costs, liabilities, the expense of judgments, including attorney’s fees and court costs, that arise out of my or my child(ren)’s willing participation in this program.  1.  The parent(s) and/or legal guardian(s) will instruct the minor participant(s) accounts including all siblings and/or family members, that prior to participating in any martial arts activity or event, he or she and/or the parent(s) and/or legal guardian(s) should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe due to damage or defect, the participant should immediately advise the officials of such condition and refuse to participate.  I understand and agree that, if at any time, I feel anything to be unsafe due to visible damage or defect; I will immediately take all precautions to avoid the unsafe area and refuse to participate further.
  
  
• I/We HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the martial arts facility used by the participant, including its owners, managers, promoters, instructors, lessees of premises used to conduct the martial arts event or program, premises, and event inspectors, underwriters, consultants and others who give recommendations, directions or instructions to engage in risk evaluation or loss control activities regarding the martial arts facility or events held at such facility and each of them, their directors, officers, agents, employees, all for the purpose herein referred to as “Ichiban Karate NKY and/or NKY Martial Arts Programs LLC”…From all liability to the undersigned, my/our personal representatives assigns, executors, heirs, and next to kin for any and all claims, demands, losses, or damages and any claims or demands therefore on account of any injury, including but not limited to the death of the participant or damage to property, arising out of or relating to the events(s) caused alleged to be caused in whole or in part by the negligence of the releasee or otherwise.
  
  

  Enrollment, Membership Holds, and Cancellation Policies
  

  • (Month-to-Month Programs) I understand that enrollment and tuition rates in any of our month-to-month karate programs are based on a twelve (12) month calendar year and can be cancelled at any time.  Students will be guaranteed ten  (10) or more available classes per month/per calendar year.  Students are permitted to place their membership on hold for 1 month per calendar with a written thirty (30) day notice).  Notices received less than 30 days from the start date of the requested hold will result in a credit to be placed on the member's account for when they return as refunds will not be given.  Requested holds longer than 30 days will be subject to loss of spot in the program and a new deposit upon return.  Does not apply to Class Passes, Seasonal Tuition Rates or Camps /Seminars.  All tuition rates are subject to an annual increase of no more than five (5) percent due to the cost of living beginning in January of the following year. 30 Day notice will be given to families for expected tuition rate increases. 
  • All Class Passes, Seasonal Tuition Rates, and/or Camps & Seminars are non-refundable unless otherwise stated in the enrollment form or promotional material. Class Passes may be shared and transferred

I/We, agree to allow my minor child(ren) or myself (all members over the age of 18 years old) to be photographed and/or recorded by video while participating in Ichiban Karate NKY martial arts classes, programs, camps, or special events.  I/We acknowledge that these photos/videos may be utilized in publications both digital and physical print for purposes of enrollment, marketing, advertising, company-approved online social media posts, or member documentation only. Information or images will not be sold, distributed, or used for any other purposes. These materials, images, prints, or online social media posts may still be used after a student or family has paused or cancelled their active membership with Ichiban Karate NKY.

In cases of shared parenting / guardian arrangements, only 1 authorized legal guardian or parent needs to sign the waiver.  Should any disputes arise for permission to photograph, or video record a minor child, please contact Ichiban Karate NKY via email (contact@ichibankaratenky.com).
